The uninspired amendment

Republican senate contenders Mike Lee and Tim Bridgewater both claim to be candidates of the Constitution. Both have claimed the need to protect its sacred words to their last dying breath or get voted in trying. That is except for one amendment.

As Andrew McCullough, Libertarian candidate for Governor points out in a recent blog, both would-be constitutionalists don’t have much love for the 14th amendment. That pesky amendment that reads: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”

McCullough points out this particular amendment ruffles all the tea-partiers feathers because it allows for so called “anchor babies,” or children born of undocumented immigrants to become naturalized citizens. McCullough points out how not only do both candidates want to repeal this amendment, but that both would be in favor of an end-run around repealing the amendment by using legislation. You know, speeding up such a long, drawn out, and democratic process designed by the founding father themselves in favor of just letting congress create its own Constitutional loophole.

McCullough writes:

“They want to ‘reinterpret’ the Constitution by act of Congress! Sorry guys, but Congress does not have that power. The plain language of the Constitution says ‘all persons.’ Is that hard to understand? Amend it if you must, but do not tell us that the Constitution does not say what it says."

Perhaps if either of these two "scholars" read a bit further into the Constitution they would also learn that the interpretation of law is the realm of the judicial, not legislative, branch of government. Good luck to us if we're stupid enough to elect either of these idiots.

 

Posted // June 3,2010 at 15:22 - You know, I saw Mike Lee's tv ad last night and all I can say is...what a complete and total, over-reaching DOUCHEBAG! He's going to go to Washington and repeal the unconstitutional "Obamacare" and to stop other items on the evil "liberal" agenda. The only thing this fool left off from a typical Utah candidate is some veiled or just breath-takingly, bald-faced reference to him being a Mormon. What this asshat doesn't apparently understand is that DC will take a radical and turn them into a moderate. You cannot play with just your own kind there. You have to negotiate, you have to have ideas that will actually work and if your constituent base are a bunch of goddam multi-level soap and fruit juice marketers spouting Palin Talking Points from back home, you're screwed as soon as you open your mouth.
